DISTRICT COURT RULES 2005 - REG 50
50 . Appeal, nature of
(1) An appeal to the
Court must be by way of a reconsideration of the evidence that was before the
primary court unless the parties agree otherwise.
(2) At the hearing of
an appeal a party must not adduce evidence that was not adduced in the primary
court except with the leave of the Court.
(3) The Court is not
to grant such leave unless satisfied there are special grounds for doing so.
(4) This rule is
subject to the written law that provides for the appeal to be made to the
Court.
